El presente artículo propone un análisis sobre el derecho a la libertad de expresión de jueces y magistrados desde la perspectiva de los estándares de derechos huma­nos en el ámbito regional e internacional, a través de la normativa y la práctica jurisprudencial al respecto. El trabajo pretende arrojar luz sobre las posibles res­tricciones a las que se podrían ver sometidos en este ámbito los miembros de la ju­dicatura con motivo del especial contenido de las funciones que desarrollan. En este artículo de investigación se muestra, que durante la fabricación de hierro, las escorias han sido una fuente información del producto obtenido. Esto aplica a toda la historia de la fabricación de este metal desde el inicio de la edad del hierro. Los estudios en este campo se conocen como arqueo de metalurgia y se inicia desde la paleo metalurgia hasta el presente. Las escorias primitivas obtenidas a partir de su separación de la masa de hierro sólida obtenidas en (...) procesos muy primitivos y más modernas como la forja catalana. Estudios petrográficos, de difracción de rayos X y de fluorescencia de rayos x, han revelado la existencia fayalita, en escorias siderometalúrgicas antigüas a temperaturas por debajo del punto eutéctico,deducidas como entre 1150°C y 1200°C. Más recientemente, la presencia de fayalita ha sido revelada en procesos de reducción operando con temperaturas menores a los 900°C. En este documento se presenta una explicación para tal hecho mediante un análisis de las energías asociadas a los sistemas. Cerámicos compuestos de FeO- SiO2-MgO- P2O5 presentes en dichos procesos. Mientras las lenguas yuto-nicaraos se expanden de Utah, EE.UU., a Nicaragua, los peregrinos del Cristo de Esquipulas viajan desde El Trifinio (Triángulo Norte de Centroamérica) a Chimayó (NM). Se exploran ambos bordes de un antiguo Virreinato al revelar su enlace por un Camino Real (entre realeza y realidad), cuyas señales olvidadas solo las reconoce una deposición testimonial subjetiva. En primer lugar, una crónica personal desglosa la extrañeza hispana (...) ante su propio legado en EE.UU., el cual los emparentaría con el Sur. En seguida, el ensayo comenta los enlaces culturales y lingüísticos ancestrales que mantienen tradiciones comunes —irreconocidas por nacionalismo cívico— entre el suroeste de los EE.UU. y el triángulo norte de Centroamérica. Este ensayo establece un estrecho diálogo entre la Filosofía, la Literatura y la Historia de las Ideas. Frente a la noción del hombre exitoso y con espíritu de liderazgo, se propone una contraposición por medio de la figura de Henry Miller y sus novelas tituladas Trópico de Cáncer y Trópico de Capricornio. El héroe de Carlyle, que termina siendo uno de los fundamentos de inspiración para el Führer de Adolf Hitler, es pensado desde la óptica del vagabundo de Miller. Many biblical scholars have underlined the importance of Numbers 13-14, especially because these chapters are a reflection on Israel's greatest sin and rebellion against God in the desert. God's reaction to that sin is clear: of all the men who have put me to the test ten times already and have failed to heed my voice, not one shall see the land which I promised on oath to their fathers. It seems that the verbs 'see' and 'hear', both sentient verbs, (...) are important in both the statement of God and that of the Spies. This article focuses on this particular point and in the conclusions which can be drawn from it. It also considers the frustrating intercession of Moses before God on behalf of his people, on account of the threat to Israel about the promised land. (shrink)

Nursing policy and healthcare reform are focusing on two, interconnected areas: person‐centred care and fundamental care. Each initiative emphasises a positive nurse–patient relationship. For these initiatives to work, nurses require guidance for how they can best develop and maintain relationships with their patients in practice. Although empirical evidence on the nurse–patient relationship is increasing, findings derived from this research are not readily or easily transferable to the complexities and diversities of nursing practice. This study describes a novel methodological approach, called (...) holistic interpretive synthesis (HIS), for interpreting empirical research findings to create practice‐relevant recommendations for nurses. Using HIS, umbrella review findings on the nurse–patient relationship are interpreted through the lens of the Fundamentals of Care Framework. The recommendations for the nurse–patient relationship created through this approach can be used by nurses to establish, maintain and evaluate therapeutic relationships with patients to deliver person‐centred fundamental care. Future research should evaluate the validity and impact of these recommendations and test the feasibility of using HIS for other areas of nursing practice and further refine the approach. (shrink)

The metaphysical question presupposes the ontological one: are there forms of social unit that can be recognized as real groups and, if so, what are they? The ontological answer can be affirmative only if we are able to identify real collective entities, that is, social wholes that are not reducible to the mere sum of their individual parts. Through an ontological comparison between different types of social interaction, this paper shows the ontological properties of a real collective subject. It is (...) such, only if relations between its constituent parts generate an intrinsic normative structure, which gives existence to a higher order of social units. In this order members are bound to each other and are collectively bound to their group. They are bearers of collective intentionality. Their actions contribute to collective agency. Their responsibility is more complex and stratified than that of an independent individual. Moreover, all types of real wholes depend on ontological constitution processes, which give them the following: an intrinsic structural unit, a typological identity and emerging properties. The latter can be both new characteristics and new causal powers, which constituent parts do not have. Therefore, a right understanding of these ontological constitution processes is capable of overcoming reductionist isomorphism. It also offers the fundamental criterion for proposing a metaphysical theory that, being rooted in a rigorous ontology, is not an arbitrary exercise of imagination. (shrink)

The Fundamentals of Care Framework is an evidence‐based, theory‐informed framework that conceptualises high‐quality fundamental care. The Framework places the nurse–patient relationship at the centre of care provision and outlines the nurse behaviours required for relationship development. Numerous instruments exist to measure behavioural aspects of the nurse–patient relationship; however, the literature offers little guidance on which instruments are psychometrically sound and best measure the core relationship elements of the Fundamentals of Care Framework. This study evaluated the quality of nurse–patient relationship instruments (...) by (1) assessing their content development and measurement properties (e.g. dimensionality, targeting, reliability, validity) and (2) mapping instrument content to the Framework's core relationship elements: trust, focus, anticipate, know, and evaluate. Twenty‐seven instruments were evaluated. Findings demonstrated that patients and nurses were rarely involved in item development. Most instruments exhibited poor measurement properties, with only one instrument having complete information on all quality indicators. Instrument content focused primarily on nurses getting to know patients and earning their trust, with only 54, 18, and 1 item(s), respectively, measuring ‘focus’, ‘anticipate’ and ‘evaluate’. Hence, there does not appear to be a robust instrument measuring behavioural aspects of nurse–patient relationships, nor one capturing the relationship elements of the Fundamentals of Care Framework. A perícope das serpentes no deserto destaca-se do conjunto de escritos que recorrem ao simbolismo da serpente, ao utilizar esse elemento potencialmente enganoso para a fé de Israel, ambivalente. Diante disso, o objetivo deste trabalho foi compreender o simbolismo da serpente em Nm 21,4-9, a partir de uma análise do texto e da possível influência por parte dos egípcios e povos do Antigo Oriente Próximo. A análise narrativa destacou o texto como um enredo de conflito-solução no drama vivido pelo povo. (...) Na ótica do conflito, foram levados em conta os aspectos antropológicos e culturais do simbolismo da serpente e seu alcance teológico. A interpretação favoreceu a compreensão da dimensão pedagógica de Deus diante da necessidade de conversão do povo que estava na etapa final da caminhada do deserto, prestes a entrar na terra de Canaã. Dentro da economia da revelação, o autor dá um novo significado à serpente levantada na haste. No início do relato, fora instrumento de castigo expresso na mordedura que causou muitas mortes; no fim, torna-se sinal de salvação. Assim, mediante o sinal, o mesmo Deus que castiga é o que está sempre pronto a oferecer uma nova chance àquele que volta seus olhos para Ele. Palavras-chave : Exegese. Números. Símbolo. Serpente. Conflitos.The pericope of the wilderness’ snakes is highlighted in the set of writings using the symbol of the serpent, for this symbol is potentially doubtful to the faith of Israel, ambivalent. Therefore, this paper aims to comprehend the symbolism of the serpent in Numbers 21,4-9, through a text analysis and a study of the possible influence of Egyptians and the nations from Ancient Near Eastern. The narrative analysis highlighted the text as a plot of conflict-solution in the drama lived by the people. In that conflict approach, it was considered the anthropological and cultural features of the serpent symbolism and its theological range. The interpretation favored the comprehension of the pedagogic dimension of God before the necessity of people’s conversion, once they were in the final stage of the wilderness’ pilgrimage, being about to enter at the land of Canaan. In line with the economy of revelation, the author gives a new meaning to the serpent raised in the rod. In the beginning of the report, it was an instrument of punishment expressed in the bite that caused a lot of deaths; at the end, it becomes a sign of salvation. The present paper proposes a definition for the complex polysemic concepts of consciousness and awareness (in humans as well as in other species), and puts forward the idea of a progressive ontological development of consciousness from a state of ‘childhood’ awareness, in order to explain that humans are not only able to manipulate objects, but also their mental representations. The paper builds on the idea of qualia intended as entities posing regular invariant requests to neural processes, trough the permanence of (...) different properties. The concept of semantic differential introduces the properties of metaphorical qualia as an exclusively human ability. Furthermore this paper proposes a classification of qualia, according to the models–with different levels of abstraction–they are implied in, in a taxonomic perspective. This, in turn, becomes a source of categorization of divergent representations, sign systems, and forms of intentionality, relying always on biological criteria. New emerging image-of-the-world-devices are proposed, whose qualia are likely to be only accessible to humans: emotional qualia, where emotion accounts for the invariant and dominant property; and the qualic self where continuity, combined with the oneness of the self, accounts for the invariant and dominant property. The concept of congruence between different domains in a metaphor introduces the possibility of a general evaluation of truth and falsity of all kinds of metaphorical constructs, while the work of Matte Blanco enables us to classify conscious versus unconscious metaphors, both in individuals and in social organizations. This article examines how third-party complaints were responded to by counsellors on a men’s relationship-counselling helpline. Much prior conversation analytic research has shown that third-party complaints in institutional settings are embedded in other activities and treated as secondary to the main interactional business. As such, complaints are routinely responded to with a shift to a new, institutionally relevant activity. In the context examined here, however, the third-party complaints constituted callers’ reasons for call. We show that, as in many other institutional (...) contexts, counsellors do not, commonly, affiliate with callers’ complaints in the sense of displaying a similar stance towards a described third party. However, unlike in other settings that have been examined, counsellors’ responses did not result in an immediate shift away from callers’ complaints. This was primarily because, following counsellors’ non-affiliative responses, callers regularly engaged in work to pursue affiliation. (shrink)

Este artículo toma como referencia la novela La ciudad y los perros para realizar un análisis intratextual, que se basa en el desentrañamiento de factores coincidentes en la obra de un solo autor. Para lograr ese objetivo, se confrontan los siguientes libros: El pez en el agua (1993), El loco de los balcones (1993), Ojos bonitos, cuadros feos (1996), Los cuadernos de don Rigoberto (1997), La fiesta del Chivo (2000), El Paraíso en la otra esquina (2003), Travesuras de la niña (...) mala (2006), Odiseo y Penélope (2007), Al pie del Támesis (2008), Las mil y una noches (2009), El sueño del celta (2010) y Fonchito y la Luna (2010). Un rasgo peculiar en esos textos es el tratamiento de la agresividad que, para esta investigación, se denominará protagonismo violento (término adaptado de la epistemología formulada por Mijaíl Bajtín). Este concepto permitirá el reconocimiento del desempeño ofuscador de los personajes principales, adscritos a una realidad oprimente y transgresora, la misma que se utiliza como justificación y causa para validar ese proceder. Eso se apreciará en las áreas relacionadas con la familia, la sociedad, la política, las organizaciones militares, la ética, el sexo y la psicología que se plasman en el discurso del escritor peruano Mario Vargas Llosa. Hegel’in, dizgesinde mantık bilimi ve doğa bilimi kısımlarından sonra gelen tin bilimi (tin felsefesi) kısmındaki öznel tin ve nesnel tinden geçerek ulaştığı mutlak tin aşaması, kendini üç aşamada ortaya koymuştur. Bunların ilki sanat ikincisi din ve üçüncüsü felsefedir. Hegel, mutlak tinin gelişiminin ikinci aşaması olan dini de _Din Felsefesi Üzerine Dersler_’inde din kavramı, sonlu dinler ve mutlak din olarak aşamalandırmıştır. 1827 yılındaki _Din Felsefesi Üzerine Dersler_’inde din kavramı Hegel tarafından yine üç aşamada değerlendirilir. Bunlar Tanrı kavramı, Tanrı bilgisi ve külttür. (...) Bu çalışmanın odaklandığı kısım din kavramı dahilindeki Tanrı bilgisidir. Dinde Tanrı olarak ortaya çıkan mutlak tin, bu biçimiyle dinin de tek içeriğidir. Hegel için böylesi bir içeriğe ilişkin bilgi de ne salt iman ya da dolaysız bilgi ile ne de rasyonel teolojinin anladığı akılla olanaklıdır. Tanrı’ya yükseliş dolaysız bilmeden başlayan ama orada kalmayan, duygu, tasarım ve düşünme aşamalarına ilerleyen bir yükseliştir. Bu çalışmada Hegel’in Tanrı bilgisi üzerine sunduğu görüşler gösterilmeden önce Tanrı bilgisine ilişkin kendisinden önceki görüşler ve Hegel’in bu görüşlere getirdiği eleştirilere değinilmiştir. Hegel bu görüşlerden özellikle rasyonel teoloji ile Kant’ın Tanrı bilgisi anlayışına ve Jacobi’de öne çıkan dolaysız bilgiye dayalı anlayışa bir yanıt vermek istemektedir. Çalışmada bu görüş ve eleştirilerin ardından Hegel’in kendi dizgesindeki Tanrı bilgisi anlayışı incelenmiştir. Tanrı bilgisi kapsamında dinsel bilincin üç biçimi yani duygu, tasarım, düşünme biçimleri ve bunların Tanrı ile ilişkisi ele alınmıştır. Bu anlamda çalışmanın amacı da Hegel için Tanrı’ya dair bilginin olanaklı olduğunun ve bunun dinsel bilincin üç biçimi olan duygu, tasarım ve düşünme biçimlerinde incelenebileceğinin gösterilmesidir. Bu makalede Erken dönem Eş‘ariyye’de dakîku’l-kelâm konusu izah edilmeye çalışılacaktır. Kelâm ilminin sistematik hale gelişinden itibaren konuları genellikle dakîku’l-kelâm ve celîlu’l-kelâm şeklinde ikili bir tasnifle ele alınmıştır. Dakîku’l-kelâm, konusu itibariyle âlem, âlemin unsurları, cevher, araz, cisim gibi fizik alanına tekabül ederken celîlu’l-kelâm ise uluhiyyet, nübüvvet ve sem’iyyât ile ilişkili olan metafizik alana tekabül etmektedir. Hicrî dördüncü asırda teşekkül eden Eş‘arî kelâm okulu varlık konusu başta olmak üzere fizik ve metafizik konuları sistematik bir şekilde ele almıştır. Erken dönem Eş‘arî kelâmında kelâm (...) ilminin fizik alanına tekabül eden dakîku’l-kelâm konularına epeyce yer verilmiştir. Bu çalışmada amacımız erken dönem Eş‘ariyye’nin Allah-âlem ilişkisi, âlemin hudûsu ve unsurları, cisim, cevher ve araz gibi meseleleri içeren dakîku’l-kelâm anlayışını sunmaktır. Allah-âlem ilişkisini ele almada daha önceleri Mu‘tezile tarafından kullanılan kelâm atomculuğunun Eş‘arî kelâmında da benimsenip benimsenmediğine değinilecektir. Aynı şekilde Âlemin işleyişinde bir zorunluluğun olup olmadığı meselesini konu edinen illiyet/nedensellik tartışmaları da ele alınacaktır. Bu çalışmanın erken dönem Eş‘arî kelâmının dakîku’l-kelâm alanındaki özgünlüğünü ortaya koymasını ve yeni çalışmalara kapı aralayarak literatüre bir katkı sunmasını umuyoruz. We consider various effects that are encountered in matter wave interference experiments with massive nanoparticles. The text-book example of far-field interference at a grating is compared with diffraction into the dark field behind an opaque aperture, commonly designated as Poisson’s spot or the spot of Arago. Our estimates indicate that both phenomena may still be observed in a mass range exceeding present-day experiments by at least two orders of magnitude. They both require, however, the development of sufficiently cold, intense and (...) coherent cluster beams. While the observation of Poisson’s spot offers the advantage of non-dispersiveness and a simple distinction between classical and quantum fringes in the absence of particle wall interactions, van der Waals forces may severely limit the distinguishability between genuine quantum wave diffraction and classically explicable spots already for moderately polarizable objects and diffraction elements as thin as 100 nm. This article analyzes the epistemic value of understanding and offers an account of the role of understanding in science. First, I discuss the objectivist view of the relation between explanation and understanding, defended by Carl Hempel and J. D. Trout. I challenge this view by arguing that pragmatic aspects of explanation are crucial for achieving the epistemic aims of science. The introduction of genomics and biobanking methodologies to the African research context has also introduced novel ways of doing science, based on values of sharing and reuse of data and samples. This shift raises ethical challenges that need to be considered when research is reviewed by ethics committees, relating for instance to broad consent, the feedback of individual genetic findings, and regulation of secondary sample access and use. Yet existing ethics guidelines and regulations in Africa do not successfully regulate research (...) based on sharing, causing confusion about what is allowed, where and when. In order to understand better the ethics regulatory landscape around genomic research and biobanking, we conducted a comprehensive analysis of existing ethics guidelines, policies and other similar sources. We sourced 30 ethics regulatory documents from 22 African countries. We used software that assists with qualitative data analysis to conduct a thematic analysis of these documents. Surprisingly considering how contentious broad consent is in Africa, we found that most countries allow the use of this consent model, with its use banned in only three of the countries we investigated. In a likely response to fears about exploitation, the export of samples outside of the continent is strictly regulated, sometimes in conjunction with regulations around international collaboration. We also found that whilst an essential and critical component of ensuring ethical best practice in genomics research relates to the governance framework that accompanies sample and data sharing, this was most sparingly covered in the guidelines. There is a need for ethics guidelines in African countries to be adapted to the changing science policy landscape, which increasingly supports principles of openness, storage, sharing and secondary use. Mühendishâne-i Berrî-i Hümâyûn hocalarından Masdariyecizâde Hüseyin Efendi 1238/1822’de doksan dereceden küçük bir açının Eukleides geometrisi yöntemleriyle üç eşit parçaya bölünmesine dair antik prob- lem hakkında bir risale kaleme alır. Risale, köklerini Antik Yunan’da bulan bu meşhur problemin Eukleides geometrisinin araçları olan çizgilik (işaretsiz cetvel) ve pergel kullanılarak ulaşıldığı düşünülen çözümünü içerir. Ayrıca, sunulan ispat Mühendishâne eğitim kadrosunun her birinin onayını gösteren imzalarla kayıt altına alınmıştır. Akademik literatürde bu risaleye dair yapılan değerlendirmelere bakıldığında, çözümde kullanımı sınırlandırılmış araçlarla bir sonuca ulaşılamayacağının Hüseyin (...) Efendi’nin risalesini yayınladığı tarihte çoktan ispatlanmış olduğu iddiasına dayanarak eser, müellif ve dönemin ilim çevresi ile seviyesi hak- kında tahkir eden genelleştirilmiş yorumlar görülür. Tüm bu güncel yayınlar, tek bir kaynaktan, Salih Zeki Bey’in konuya dair yaklaşık bir asır önce kaleme aldığı ve içerik itibariyle doğruluğu tartışılır makalelerinden neşet etmiştir. Bu çalışma bu güncel yayınların ortak kaynağının iddialarını inceler ve problemin çözümü- nün tarihine odaklanır. Böylece verilen hatalı bilgilerin tashihini sunar. (shrink)

La contribution de Michel Troper à la théorie générale du droit et à la théorie constitutionnelle est aujourd'hui reconnue et célébrée un peu partout dans le monde. Un talent d'architecte se tient à l'origine de cette audience rarement égalée dans la sphère francophone : celui qu'il faut pour accommoder toutes les exigences, quel que soit l'ordre de valeur dans lequel on les trouve : originalité, rigueur, souci de la fonction, esthétisme, solidité, adaptation, intelligence, inquiétude, esprit critique, renoncement, réalisme... A ces (...) mérites, on ajoutera une curiosité insatiable, un goût prononcé pour l'échange et le débat, un refus distingué de l'académisme, un sens exigeant de l'amitié et une méfiance profônde pour les adjectifs... C'est cet édifice de qualités que les élèves, collègues et amis de Michel Troper sont heureux de célébrer en lui offrant ces Mélanges. (shrink)
